States Step Up on Election Integrity While Congress Fails to Act
While Washington stalls on the SAVE America Act, Republican-led states are delivering real protections for American elections.
Senate Republicans appear unwilling to go to the mat for the Safeguard American Voter Eligibility (SAVE America) Act, which mandates citizenship verification to register to vote, a valid photo ID to cast a ballot, and cuts down on mail-in voting abuse. But that doesn't mean these protections won't exist anywhere in the 2026 midterm elections. Many Republican-led states have taken the initiative to pass some of these safeguards themselves, guaranteeing that at least their constituents will get what they voted for in the last election.
Noncitizens frequently do appear on voter rolls and cast ballots, Democratic denials notwithstanding. Recently, New Jersey Democrats were forced to admit that 6,600 noncitizens registered to vote in their state—400 of whom cast ballots.
This latest incident underscores what conservatives have trumpeted for years: the integrity of our elections depends on ensuring that only eligible United States citizens can register and prove their identity when they vote.
Americans across the political spectrum agree with this.
Allowing even the possibility of dilution by those who are not citizens undermines the American principle that government derives its just powers from the consent of the governed. The SAVE America Act is the all-encompassing remedy to the problem of noncitizens voting—a solution that would settle this issue once and for all at the federal level.
But rather than give conservative voters what they want, Senate Republican leadership has used anger at the federal government's inaction on election integrity to fundraise.
Thankfully, Republican legislators and governors aren't waiting on the Senate. They're setting an example by passing their own versions, giving their residents peace of mind that at least their states' elections will be secure.
Leading at the State Level
Florida stands out as a prime example. Ever since the chaos of the 2000 election forced the Supreme Court to intervene, the Sunshine State has worked to lead the way in running secure, smooth elections.
In April 2026, Gov. Ron DeSantis (R) signed HB 991, requiring documentary proof of U.S. citizenship—such as a birth certificate, passport, or naturalization papers—for voter registration. The law also records citizenship status clearly in the statewide system, with full implementation set for January 2027.
South Dakota and Utah have enacted similar requirements, joining Arizona, New Hampshire, Wyoming, Indiana, and Mississippi in demanding tangible evidence of citizenship.
These laws codify the most important aspect of the SAVE America Act—documentary verification of citizenship. They offer reassurance that, despite Congressional inaction, their elected officials—at the state level, at least—are doing their job and providing for secure elections.
Empowering Change Beyond the Headlines
Self-government is built on trust in the electoral process. When Americans find out that noncitizens are registered to vote—or actually voting—it erodes that trust. The cynicism this produces causes many to see no point in voting—especially when they repeatedly vote for Republican Senators who take them for a ride for their money while doing nothing to keep noncitizens away from the polls.
Thankfully, despite a handful of recalcitrant Republicans-in-name-only in the Senate, state-level Republicans are doing what they can with the majorities they possess to enshrine the principles of the SAVE America Act in their states' statutory codes.
Republicans should not get discouraged because the Senate refuses to fight. Many of the staunchest warriors for election integrity are unsung heroes in state legislatures doing what they can to make sure their constituents get to enjoy elections open only to eligible American citizens. But keeping these legislatures in Republican hands and ensuring Democrats can't undo the good work they've done requires voters to reward them at the polls this November.
