Will Virginians Give Buta Biberaj the Boot In November?

Loudon County’s aggressively anti-parent district attorney is facing a tight reelection campaign next month. Virginians have an opportunity to replace this far-left, Soros-backed radical—and reinstate the rule of law.

Americans are all too familiar with a disturbing new trend nationwide: Soros-backed prosecutors are releasing criminals for lower level offenses, only for them to carry out more serious crimes like murder, assault, and rape after going free. No one captures the Left’s war on the rule of law better than Loudon County district attorney Buta Biberaj.

Her office directed government prosecutors earlier this year to ignore cases where defendants are drunk in public, trespass, commit petty larceny, or stand accused of other infractions—including reckless driving, hit and runs involving property damage, and traffic cases where suspects evade police.

Several attempts have been made to recall Biberaj. All have all failed. She went on to prevail in her Democratic primary and will now face Republican Bob Anderson, who formerly held the commonwealth attorney’s post in Loudoun County. Recall that Biberaj won her first election in 2019 with a slim majority of 51.2 percent, making the upcoming race a tossup worthy of time, resources and attention.

Now she’s up again in Virginia’s November 2023 election, and the stakes couldn’t be higher.

Assault Against Parental Rights

In 2021, Biberaj’s office targeted a father who stood up to Loudoun County school board members about his daughter’s sexual assault perpetrated by a male student wearing a skirt in the girls’ bathroom. Instead of going after the alleged offender, the DA charged the father—Scott Smith—with disorderly conduct, sending a clear message to outspoken parents: If you push back, we will lock you up.

Biberaj hoped to put Smith behind bars, even though the same student who assaulted his daughter was arrested for a similar crime at another school.

The teen was convicted in both cases, after being found guilty of assaulting a student at Broad Run High School, where he’d been moved following the first incident. The defendant was not jailed though, after Smith’s wife pleaded with the Judge to allow the offender a chance at rebuilding his life.

Smith later appeared on Fox News to highlight why Biberaj must be voted out of office:

She is one of the most evil people I ever met . . . Unfortunately, I had to deal with her face to face with the prosecution of the sexual predator of my daughter. . . We need to vote her out.

He was granted a pardon by Republican Gov. Glenn Youngkin in 2023 after the governor’s office claimed there was a political coverup at play. Biberaj was removed from Smith’s disorderly conduct case before Youngkin pardoned him, with the presiding judge writing:

The concerns about the public confidence in the integrity of the prosecution as well as the Defendant’s concerns regarding the impartiality of the Commonwealth’s Attorney are sufficiently grounded. As a result, the integrity of the Defendant’s due process rights is in jeopardy and must be protected.

Biberaj was part of a Facebook group named “Anti-Racist Parents of Loudoun County” made up of current and former teachers—along with influential lawmakers—seeking to compile a list of parents who are critical of the school system.

The group’s sinister goal was to silence parents by “infiltrating” the anti-CRT movement, using fake online accounts and encouraging “hackers” to shut down certain websites, while redirecting users to pro-CRT platforms.

Shameful Record of Supporting Criminals and Defying the Law

Biberaj’s office mistakenly freed a man who was charged with second-degree murder in 2022 after he was accused of stabbing his brother’s girlfriend to death the year before.

Prosecutors claimed they’d dropped the charges to avoid the suspect’s commitment to a mental hospital. This does not explain why Biberaj’s office failed to file new charges before dropping the original ones. But due to this error, police had to release the suspect which allowed him a chance to flee, before he was apprehended in Georgia soon after.

That same year, Biberaj’s office hired a registered sex offender who had been convicted on child pornography charges to serve as a paralegal. The sex offender—identified only by his first name—later told reporters he was shocked that his past wasn’t discovered sooner:

I was expecting there to be the background check. . . But instead it turned into, ‘Here’s your badge, here’s all the access you need for the computers,’ and things just kind of went rolling from there. . .  I would immediately start working on different cases and had immediate access to the files.

He was fired days later, but this lapse in judgement is unforgiveable.

Biberaj was kicked off a case in June 2022 by the same judge who removed her from the Smith case, for “deliberately misleading the court and the public” about a burglary suspect to get a plea deal accepted.

The offender had been convicted on felony charges and was considered a serial burglary suspect. Something Biberaj’s team omitted when presenting their plea agreement to the judge. After the story broke, a former prosecutor from her office spoke with Fox5 DC on condition of anonymity and said attorneys who worked for Biberaj were “pushed to bond people out in domestic violence cases,” and that “Buta pushes to let people out generally.” 

Despite pushback, bad press, and being hit with a state bar complaint, the Virginia Supreme Court reinstated Biberaj to the burglary case only months later. The state’s high court focused on Biberaj’s due process rights, but what about the victims who’ve been irreparably harmed by her policies?

Another Foot Soldier for Soros Making the Streets Less Safe

Biberaj is tied to leftist mega-donor George Soros and earned his support during her first campaign in 2019, when she received $861,039 from the Soros-funded PAC Justice and Public Safety helping her win a tight race. 

Like other Soros-backed DAs, she appears drunk on her own power and will work to retain her authority, whatever the cost.  

In 2023, Biberaj used her office’s resources to make personal and political requests through the Freedom of Information Act (FOIA), for communications between county supervisors, as well as current and former political rivals. She used her official government email–and title–when filing the requests and sought conversations between local reporters and the county board of supervisors.

If the Republican candidate Bob Anderson hopes to defeat her, he will need increased donor funding, volunteers, social media attention and support at all levels.

How to Defeat This Rogue Prosecutor Movement

Unlike Florida or Georgia, Virginia does not empower the governor to aid in the removal of prosecutors for misconduct or failure to carry out their oaths. Current law states there must be a petition signed by at least 10 percent of the number of constituents who voted in the previous election. That petition must then make its way to a circuit court, where judges are weary to remove an elected official. The statue reads, in part, that removal can occur for:

Neglect of a clear, ministerial duty, misuse of the office, or incompetence in the performance of the duties of the office when that neglect of duty, misuse of office, or incompetence in the performance of duties has a material adverse effect upon the conduct of the office.

Restoration News spoke with former Virginia Attorney General Ken Cuccinelli, who previously served as Deputy Secretary of Homeland Security in the Trump administration. Cuccinelli explained that the best way to counter these rogue DAs would be if voters flip the Senate to Republican control in November and reform the entire justice system.

“A petition for removal almost never succeeds,” said Cuccinelli, who formerly served in the Virginia Senate and is now national chairman of the Election Transparency Initiative. “The judges are very loath to engage in attempting to override an election. [Biberaj] is elected. I’m not glad she was elected. . .  She’s become a lot more irrational over the years. And unfortunately, people are getting what they voted for here. But that is the only removal option.”

Cuccinelli pointed out that Republicans are very likely to pass a bill giving the General Assembly power to remove rogue prosecutors like Biberaj. “I’d be astonished . . . if they didn’t do something like that,” he said. “This is one of those things that would change with an election.”

Republican Attorney General Jason Miyares is leading by example on this issue, by highlighting the importance of voter turnout and civic involvement.

Miyares’ office told Restoration News: 

Far left prosecutors who put criminals before victims and ignore the rule of law are a public safety risk. In order to protect our communities, Americans must pay attention and participate in every election.

Miyares also chairs the Protecting Americans Action Fund, an organization seeking to reign in this insanity.

The Protecting Americans Action Fund and its partner nonprofit group, the Protecting Americans Fund, raised $4 million in 2022 for prosecutor races. It invested in more than 12 competitive races and flipped five district attorney offices from liberal to conservative. 

Gov. Youngkin should remain on guard with his pardon pen ready though, as Scott Smith is likely not the last citizen to be politically persecuted.

Helping fund victims who may have been harmed because of Biberaj’s maleficence–and encouraging them to file civil lawsuits—would further expose the need for reform and help the public see this agenda for what it is: An attack on our way of life.

If rogue DAs cannot be beaten at the ballot box, they must be held accountable by citizens. Winning an election does not absolve someone of their duty.

It starts with Virginia’s citizenry. Yet they will not be able to fight this battle alone. They can vote in the upcoming off-year elections this November, but if Biberaj is still standing, Republican state leaders must form a coalition and attack from all sides.

If such actions are met with indifference by the GOP, Soros’ agenda will continue strangling the state and spread like a cancer throughout the entire country, until it has metastasized to all 50 states, eviscerating public safety and the wellbeing of all Americans.
