Lawsuit Challenges Virginia's Abortion Amendment

However, she emphasizes that the underlying legislation prohibits prosecution of anyone obtaining or providing an abortion “for any reason.” This means a doctor could perform a late-term abortion at 40 weeks with the mother’s permission and face no legal consequences, effectively removing meaningful limits.
Additional hidden implications: the amendment would override existing laws requiring parental consent for minors seeking abortions or contraception. Manning notes a recently passed law (signed by Gov. Spanberger) that defines contraception broadly to include sterilization procedures, with no age requirement or parental notification. A 13-year-old could request and receive a vasectomy or hysterectomy without parental knowledge or consent. These provisions, she argues, are not disclosed in the ballot language, creating a major transparency failure.
Manning ties this to a pattern of deceptive ballot crafting by Democrats, comparing it to the redistricting amendment. She points out that the ballot question did not get distributed 90 days before the 2025 election as required by law. The abortion amendment could undermine current protections and enshrine extreme policies into the state constitution, making them far harder to reverse.
