Paxton-Talarico Voting Controversy Shows Why Voter Roll Transparency and Clean Rolls Are Crucial

A residency scandal in the Texas Senate race exposes a system that tolerates outdated addresses until journalists or opponents force the issue.

A residency scandal engulfing both candidates in the Texas Senate race demonstrates the need for clean, current, and transparent voter rolls to avoid illegal voting and a slide in public confidence in elections. Both Texas Attorney General Ken Paxton (R) and his opponent, State Rep. James Talarico (D), allegedly spent years voting from addresses they no longer occupied.

Texas law requires voters to register and cast ballots from the address where they live. But Texas courts apply a broad, multi-factor residency test, and criminal charges require proof of knowing intent—so neither candidate faces prosecution. But the optics are damaging to both candidates, the counties they voted in, and the state of Texas.

Two Candidates, Same Problem

ProPublica and The Texas Tribune reported that Paxton voted in six elections, including the March Republican primary and May runoff that made him the nominee, from a Collin County home he no longer occupied. His divorce filings indicate that he had moved away more than two years earlier. The reporting linked him to a property in neighboring Denton County since February of this year. Rather than address the issue professionally, his sloppy campaign called the story a "baseless tabloid" piece but offered no timeline for his move or explanation for the unchanged registration.

Talarico naturally piled on at campaign rallies and on social media.

But follow-up reporting from ProPublica found that Talarico appears guilty of the same charge. He had registered at his parents' Austin home in November 2021 but bought his own in June 2022 without updating his registration until September 2024. During that time, he voted in five elections from the parents' address. Both properties are in the same county and state House district but in different local jurisdictions for some races. His campaign declined to specify a move-in date to his home, citing alleged threats from "right-wing actors."

The common thread here is a system that lets outdated addresses linger indefinitely until the illegal voter becomes famous. But if high-profile candidates can do this, how many ordinary voters quietly do the same?

The Fix: Aggressive List Maintenance and Voter Roll Transparency

Restoration News has long advocated for the durable solution to problems like this: continuous voter-list maintenance paired with radical transparency that makes every man an auditor.

To strengthen voter-list maintenance, county officials should run ongoing electronic cross-checks with Department of Motor Vehicles records rather than waiting for periodic statewide cleanups. Frequent National Change of Address (NCOA) sweeps would also catch Postal Service-reported moves and trigger confirmation notices.

Texas does have a good voter ID law, but it could be strengthened. It requires a government-issued photo ID that matches the voter's registered name. However, a voter may use an expired ID for up to four years. This means someone could change addresses and continue using the driver's license from the old address to vote. Legislatures should require that addresses on voter registrations and photo IDs match before ballots are issued. At the very least, they should require voters who lack matching addresses to use provisional ballots.

Additionally, voter rolls should be easily available to everyone, not just political parties and investigative journalists. This would help ordinary citizens catch discrepancies in their own registered addresses and others'. Voter Reference Foundation (VRF) currently makes this data freely available for 36 states and D.C. at voteref.com, empowering citizens to examine the rolls themselves.

VRF Executive Director Joseph Benson told Restoration News that the Texas case "is a prime example of why having the voter rolls available for public inspection is so important to hold our leaders, and ourselves, accountable."

"Representative government only works if votes reflect the people actually living with the consequences of those votes," he added. "Having skin in the game matters. Your community's voice, not someone else's, shapes the laws and leaders that govern it."

Clean rolls protect every race—from U.S. Senate to county commissioner—by removing the excuse for laziness when it comes to voter registration updates. Texas should use this situation to lead the way on voter roll address verification reform. It can do this through more aggressive statewide voter roll maintenance, frequent NCOA sweeps, a tighter voter ID law, and full voter roll transparency. Without these steps, residency scandals will continue to recur and erode Texans' trust in election outcomes.
