HYPOCRISY: 5 Times Leftists Ignored Due Process While Screaming About Trump
Democrats and their judiciary allies love to lecture Trump and Republicans on due process, but their record on the subject is abysmal.
Legacy media repeatedly accuses President Donald Trump and his administration of due process violations in its enforcement of immigration law but ignores its recent sordid history of constitutional violations.
When it furthers their agenda, Democrats and the left-wing judges they install have repeatedly government overreach when it suited them, undermined due process, the rule of law, and the separation of powers. Here are 5 examples of such overreach.
COVID-19 Vaccination Mandates
The Biden administration imposed draconian COVID-19 vaccination mandates on federal workers, contractors, and private sector employees.
In mid-2021, the Biden required all federal employees and on-site contractors to get vaccinated or wear a mask at all times and face weekly testing and travel restrictions on official travel.
On Sept. 9, 2021, he signed an executive order, requiring all federal workers and military personnel to be vaccinated with no testing alternative. This resulted in over 8,400 dismissals of military personnel by early 2023 despite falling recruitment.
He also ordered all healthcare workers at hospitals receiving Medicaid and Medicare funding be vaccinated with no testing option, an order that affected over 17 million workers at over 50,000 hospitals, a policy Democrat-controlled states had already implemented.
Biden even tried to use OSHA to force companies with over 100 employees to require vaccination from their employees or require weekly testing.
These actions were not only unnecessary, considering the minimal danger posed by COVID-19, but blatantly unconstitutional. Thankfully, the Supreme Court’s conservative majority ruled against Biden’s OSHA and federal employee mandates.
Democrats, who normally pretend to care about workers’ rights and oppose authoritarianism, celebrated the mandates and the firings of workers who refused vaccination.
Jan. 6 Prosecutions
Democrats have touted the prosecutions of individuals involved in the Jan. 6 riot as proof Trump and his supporters are threats to democracy. While some defendants committed clear crimes, Biden’s DOJ and liberal prosecutors and judges seriously violated many defendants’ due process rights.
Despite the Sixth Amendment’s guarantee of a speedy trial, many defendants faced years-long pretrial detentions in the Washington, D.C. jail. Prosecutors piled on charges, stretching unrelated statutes, hoping to put many behind bars for decades. Liberal judges, particularly in D.C., then denied bail for some and over-sentenced most.
Although Democrats shed crocodile tears for violent Black Lives Matter rioters and paid their bail, they celebrated the politically motivated over-prosecution and over-sentencing of Jan. 6 protesters.
Lawfare Against Trump
The relentless persecution Trump faced when the Left realized he planned to run for president again provides the starkest example of Democrats’ hypocrisy.
At the state level, the Colorado Supreme Court—whose Justices were all appointed by Democrats—unconstitutionally ordered Trump removed from the state’s ballot, citing the 14th Amendment’s clause against insurrectionists holding office. Maine’s Democrat Secretary of State tried the same. So outrageous was this usurpation of constitutional interpretation that the Supreme Court ruled 9–0 to overturn it.
Although a Special Counsel report said Biden “willfully retained and disclosed classified materials,” he faced no charges because he was an “elderly man with a poor memory.” Nevertheless, the FBI raided Mar-a-Lago over the same allegations, 40 felony counts and possibly decades in prison if convicted.
From frivolous civil fraud cases related to his business and alleged former affairs, New York Attorney General Letitia James and Manhattan D.A. Alvin Bragg tried desperately to bankrupt him or put him behind bars before the electoral clock ran out.
Democrats supported these efforts in an ends-justify-the-means crusade, showing they selectively champion due process when it serves their narrative—defending immigrant and minority criminals—but ignored it when trying to rid themselves of Trump.
Judge Boasberg’s Contempt(ible) Push
Democrats rail against the Trump administration for allegedly ignoring judges’ rulings as he seeks to protect the country from terrorist gangs and enforce immigration law. However, Democrats’ latest hero, Washington, D.C. District Judge James Boasberg, retroactively pursuing contempt charges against the Trump administration for defying his temporary restraining order after the Supreme Court struck down his temporary restraining order.
Boasberg ruled the Trump administration cannot use the Alien Enemies Act to deport violent gang memebrs. The Supreme Court overturned his order, but Boasberg continued his contempt proceedings until the U.S. Court of Appeals restrained him.
Democrats would throw a tantrum if a conservative lower court judge attempted the same.
Nationwide Injunctions: District Judges as Policymakers
Nationwide injunctions by liberal district judges marks ultimate violation of the separation of powers and the rule of law in which Democrats claim to believe anytime Trump issues an executive order they don’t like.
Democrats have turned to left-wing courts, knowing Democrat-appointed judges will side with them. But rather than issuing limited injunctions in those courts’ jurisdictions or limiting their rulings to the defendants themselves, these judges have halted Trump’s policies nationwide.
These rulings usurp the rights and obligations of the executive branch, as well as those of the higher courts. Although the Supreme Court will ultimately strike down most of these injunctions, until the Senate passes the No Rogue Rulings Act, these judges will cause significant harm to Trump’s ability to do his job.
Democrats view nearly every action by Trump to fulfill his duties under Article II of the Constitution as a violation of due process, the rule of law, and separation of powers. Yet, the Biden administration and Democrats’ allies on the bench show they see these concepts as mere tools to prevent conservative policies from being enacted, thereby overturning the will of the people.
