Congressman Don Davis Consistently Sides with Illegal Aliens over North Carolinians
It's time to retire Davis and his record of leniency toward foreign criminals
Rep. Don Davis (NC-01) has consistently voted for policies that undermine border security and enable illegal aliens to evade deportation. As a state senator and a congressman, he has opposed border enforcement, deporting illegal aliens, and putting North Carolinian citizens first. With the 2026 election looming, his tolerance for illegal immigration should disqualify him as a competent representative for his constituents.
Before President Trump took office, North Carolina was home to 500,000 non-citizen immigrants—65 percent of whom were illegal aliens. As Restoration News reported at the time, this produced a significant strain on housing costs for poor and low-middle class North Carolinians. Davis's voting record enabled that.

Davis's Record on Illegal Immigration as a State Senator
Davis demonstrated early on in his political career his willingness to prioritize the interests of illegal aliens over the safety and jobs of North Carolina’s citizens.
As a state senator, in June 2016, he voted against HB 100—a bill meant to rescind state funding from sanctuary cities.
Later, in June 2019, Davis decided to sit out a vote on HB 370, a critical bill requiring North Carolina sheriffs to cooperate with Immigration and Customs Enforcement (ICE). His absence allowed him to avoid taking a stand on strengthening local-federal partnerships in detaining and deporting illegal aliens. By failing to vote, he effectively sided with the pro-illegal alien lobby that seeks to obstruct ICE’s efforts to remove dangerous individuals from communities by relying on liberal law enforcement to shield them.
In early 2022, Davis sat out a vote on another bill, SB 101, mandating local cooperation with ICE. He later voted against it when it came before the state senate in July, leaving no doubt where he stands on the issue.
This is a slap in the face to taxpaying North Carolinians in his district. Davis's votes in the state senate effectively shielded unvetted foreign workers who undercut the wages of his own voters, and may have posed a security risk to their communities.
Same Policies, Higher Office
Since arriving in Congress, Davis has only intensified his troubling record on illegal immigration.
In May 2023, he voted against H.R. 2, the Secure the Border Act of 2023, aimed at tackling the crisis at the southern border created by former President Joe Biden. The bill introduced measures designed to deter illegal crossings and ensure only legally authorized workers filled American jobs. These included limits on asylum eligibility to curb abuse of the system and requirements for employers to check the legal status of potential employees through E-Verify.
Davis’s vote against it rejected these priorities, aligning him with big business advocates and open-border radicals who favor cheap labor and mass immigration over Americans' economic well-being and safety.
In July 2023, he voted against H.R. 3941, the Schools Not Shelters Act. This bill aimed to prohibit schools that receive federal funds from housing or sheltering illegal aliens—as was occurring in New York City, sparking fierce protests from parents in traditionally Democrat neighborhoods.
Davis's decision to prioritize the comfort of foreigners who break America's laws over the educational and safety needs of American children speaks loudly about his priorities and political loyalty.
In May 2024, Davis voted against H.R. 7109, the Equal Representation Act, which would have required census questionnaires to include questions about citizenship status. This simple measure aimed to ensure accurate representation by distinguishing between citizens and non-citizens, including illegal aliens, in apportioning congressional seats.
Large concentrations of illegal aliens provide Democrats with overrepresentation even if they don't illegally vote. They do this by being counted in the census, allowing Democrat representatives to get elected in a district that has significantly fewer American citizens than areas with fewer illegal aliens. By opposing H.R. 7109, Davis endorsed a system that dilutes the voices of American citizens.
Davis's votes on immigration-related bills reveal a distinct pattern. Over and over, he chooses to obstruct efforts to crack down on illegal immigration. This includes opposing laws that would require local sheriffs to cooperate with ICE and ban schools from becoming immigrant shelters. His refusal to back a moderate proposal to include citizenship status on the census shows he toes the Democrat Party line on using increased illegal immigration for a partisan advantage.
Americans, no matter where they live, shouldn't have to worry about their community becoming an illegal alien magnet if they get a liberal mayor or sheriff. Voters in northeastern North Carolina deserve a representative who will fight for secure borders, prioritize American citizens, and ensure that illegal aliens face swift deportation.
Davis’s record proves he is not that representative. Next November, they should reject him at the ballot box and send a representative to Washington, D.C. who will put them first, not illegal aliens.
