Activist North Carolina Justice Anita Earls Is Hooked on Racism

Conservative voters must forecast future majority vulnerability in North Carolina Supreme Court judicial race.

North Carolina voters have a rare chance to get rid of an activist judge on the state's top court in the upcoming election. Anita Earls, the incumbent far-left justice on the state's top court, wants another eight-year term so she can continue to apply racism to virtually everything she sees.

North Carolina requires justices to retire at 72, or at the end of a term after they turn 72. Earls is 66, and, if reelected, she will be 75 when her term ends in 2035.

The seven-member North Carolina Supreme Court has five Republicans and two Democrats. The long-game strategy for Democrats has been to flip power in state supreme courts to Democrat control. In 2028, three Republican seats will come open at the same time. Democrats will put millions of dollars into trying to flip all three seats. If successful, they will have a 5-2 Democratic majority for years to come.

Flipping the seat to Republican now protects the Republican majority in 2028. Then, even if Democrats win all three seats, the balance will still favor Republicans four to three Democrats.

Career Based on Race

Beyond party control, voters should consider Earls' proclivity to see the world through a racial and sometimes anti-white lens.

She is the founder of the Southern Coalition for Social Justice (SCSJ), formed to "give Black, Brown, and low-income people better resources in the fight for justice across the South," according to its website. SCSJ focuses on "voting rights," claiming it "protects the rights of communities of color by defending the Voting Rights Act through fair redistricting and minimizing elections administration practices that threaten free democratic participation in elections such as photo ID requirements, restrictions on voter registration and early voting, and Election Day voter challenges."

The $6 million nonprofit also rails against all the far left's favorite issues, "racial profiling, mass incarceration, systemic racial discrimination, inequities at all stages of the system, criminalization of youth based on skin color, environmental inequities, discriminatory land use," according to its tax-exempt filing.

SCSJ often partners with the disgraced Southern Poverty Law Center, for example, challenging congressional district maps.

In 2023, the state judicial ethics panel investigated Earls in connection with complaints she made in an interview with Law360 about the "implicit biases" of other justices on the bench, and that the legal system in North Carolina lacked diversity.

Earls claimed her fellow justices were "acting out of racial, gender, and/or political bias in some of their decision-making." That is the kind of claim you make when everything you see goes back to race.

She went to court to block the ethics probe but ultimately dropped that case when the ethics panel dropped its investigation.

Earls doesn't like her coworkers but wants to keep working with them.

Former North Carolina State Rep. Sarah Stevens, a Republican, left her seat in 2026 to challenge Earls. She was speaker in the state House 2017-2025 and served on the Justice and Public Safety, Election Law, and Hurricane Helene Recovery House committees.

Voters sometimes overlook vital judicial races. It's hard for judicial candidates to get their messaging out, and voters forget how much power the court has over their lives.

In recent years, the North Carolina Supreme Court weighed in on a congressional redistricting case, photo voter ID, and voting rights for convicted felons. No one should expect Earls to bring an unbiased view of these issues to the table; she built her nonprofit firmly on the far-left side of these issues. Judges should make decisions based on the rule of law, not their activist heart.
