Virginia High School Students Push Back on Trans Student’s "Sexual Harassment" Claims

The boys’ attorney says they are being targeted for exercising their free speech.

Three male Stone Bridge High School students in Ashburn, Virginia, are fighting back against sexual harassment allegations after questioning why a female classmate was in the boys’ locker room.

Loudoun County Public Schools opened a formal investigation into the male students after the trans-identifying female filmed them voicing their confusion and discomfort over her presence in the locker room. The female student filed a Title IX complaint about the incident last month, prompting the investigation.

Founding Freedoms Law Center attorney Josh Hetzler, who represents the male students, said no investigation was warranted.

"They only asked questions that any boy in that situation would have asked other 15-year-old boys," Hetzler told Restoration News.

According to Hetzler, the video shows one of the boys asking why a girl was in the locker room, with another stating: "I’m uncomfortable." Those comments, he added, weren’t directed at their female classmate but at each other.

Yet the female student, he said, recorded the boys without their knowledge or consent and in violation of school policy, which prohibits photography and audio or video recording in school bathrooms, locker rooms, changing areas, or clinics. 

Hetzler said at least one of the boys’ parents has filed a complaint concerning that breach of policy. While it remains unclear if the school division will investigate that issue, Hetzler said the probe into his clients’ speech is "very concerning."

"We think they have a First Amendment right, and we’ll be asserting that in whatever venue we need to."

Virginia’s Republican governor, Glenn Youngkin, echoed that concern as he announced a probe into Loudoun County’s response to the incident.

"It’s deeply concerning to read reports of yet another incident in Loudoun County schools where members of the opposite sex are violating the privacy of students in locker rooms," Gov. Glenn Youngkin said in a May 6 statement.

"Even more alarming, the victims of this violation are the ones being investigated—this is beyond belief. I’ve asked Attorney General [Jason] Miyares to investigate this situation immediately so that every student’s privacy, dignity and safety are upheld." 


Youngkin’s administration put forward guidelines in 2023 requiring students to use the bathrooms and locker rooms that align with their biological sex.

Hetzler said Loudoun County was in clear violation of those guidelines, as well as President Donald Trump’s executive order dismantling gender ideology extremism in the federal government. 

"Loudoun County is certainly in defiance of the law, but maybe even more significantly, they’re just in defiance of common sense and biological realities," Hetzler said. "They need to end this policy of allowing boys and girls into opposite sex locker rooms and bathrooms, and they need to protect the privacy of all students."
