Protect Gun Rights for Citizens, Not Illegal Aliens
While “progressive” judges make rulings to permit illegal aliens to carry firearms through judicial activism, Republican legislators are steadfastly pursuing measures to monitor attempted firearm purchases by illegal aliens.
While Democrats are trying to arm the non-citizens entering our country illegally, Republicans like Sen. Tom Cotton (R–AR) are spearheading efforts to prevent illegal immigrants from buying firearms.
Republican lawmakers introduced legislation in April that mandates the National Instant Criminal Background Check System (NICS) to alert U.S. Immigration and Customs Enforcement (ICE) and pertinent local law enforcement agencies whenever an illegal immigrant attempts to purchase a gun. The FBI currently maintains a record of prohibited persons that includes 14.8 million illegal aliens, but NICS is not required to notify authorities if an applicant is in the country illegally.
“Those who come into America illegally should be detained and deported. They certainly shouldn’t be able to purchase a firearm. Our bill is necessary to ensure the proper authorities are notified when an illegal immigrant attempts to buy a gun,” said Sen. Cotton.
The legislative push to crack down on illegal aliens comes at a necessary time, as a “progressive “judge appointed by former president Barack Obama ruled in March that illegal aliens have the constitutional right to exercise the Second Amendment. District Judge Sharon Johnson Coleman decided to dismiss the charges of unlawfully possessing a firearm against illegal immigrant Heriberto Carbajal-Flores.
Coleman justified her decision by stating that the firearm was intended for “self-defense” amidst significant “civil unrest” in Chicago.
“I have no confidence in this administration’s willingness or ability to prevent illegal aliens from unlawfully entering our country, let alone in preventing them from illegally obtaining a firearm,” said Sen. Cynthia Lummis (R–WY), a member of the coalition.
Since 1998, NICS has issued 49,411 denials to illegal aliens who attempted to buy a firearm. The new legislation would direct those denials to the proper agencies for prosecution.
“Alerting the proper authorities when illegal immigrants seek to obtain firearms is common sense,” said John Boozman (R–AK).

Criminals Committing Crimes
Restoration News has documented numerous instances where illegal immigrants have been found in possession of firearms during criminal activities. Many times, the situation ends in violence.
In March 2024, authorities apprehended Honduran national Bayron Santos-Recarte after he allegedly retaliated against a federal witness related to a trial involving the ultraviolent Venezuelan MS-13 gang.
Santos-Recarte allegedly “took the witness by force and at gunpoint and placed him in a truck where they tied his hands together. They allegedly interrogated him for hours about his trial testimony and repeatedly assaulted him before he was able to escape.”
Later that month ICE arrested an illegal alien for involvement in a drive-by shooting. The suspect, Adelvis Rodriguez-Carmona, is an alleged member of a Venezuelan transnational street gang.
Venezuela is refusing to take him back.
Another illegal alien from Mexico was sentenced to 28 months in prison for possession of a firearm by an illegal alien and using it to commit domestic violence.
Restoration News was able to record 509 arrests of criminal illegal aliens in March 2024 alone, including 16 murderers. This builds on hundreds of illegal alien crimes traced in February.
In April, Kenol Baptiste, an illegal immigrant from Haiti, allegedly killed his two roommates. He was charged with second-degree murder, first-degree manslaughter, and fourth-degree criminal possession of a weapon. Baptiste was able to enter the country due to President Joe Biden’s CBP One app.
Illegal immigration has run rampant under the Biden administration, as nearly 2.3 million illegal immigrants have crossed the border, as reported by the Federation for American Immigration Reform.
This estimate, calculated by the organization to make up about 16 percent of the estimated 16.8 million illegal immigrants in the United States, highlights significant shortcomings in effective border control policy.
Moving Forward
Sen. Cotton and the coalition of Republican lawmakers are working towards the right goal of prosecuting and deporting illegal immigrants who attempt to purchase firearms.
Unfortunately, the Left remains resolute in prioritizing the protection of illegal immigrants over American citizens. With Biden’s continued support of open border policies and activist judges granting Second Amendment rights to illegal aliens through judicial activism, many Americans find themselves in perilous circumstances.
Lawmakers must take action to secure the border and implement measures that prevent dangerous criminals from carrying firearms. The American people deserve better.
